Trump administration reportedly favors holding AI developers liable under existing law over new rules, raising questions on agent accountability

Announced October 10, 2026

What happened

ZDNet Korea relayed a Bloomberg report (Oct. 10, local time). The Trump administration is pursuing a plan to hold AI developers liable for incidents under existing laws rather than creating new AI safety regulations. According to the report, Treasury Secretary Scott Bessent and former White House AI czar David Sacks believe liability for damages under current law is more effective than new regulation, and President Trump has argued that the Justice Department should step in if an AI model goes out of control. Earlier, on Oct. 9, the administration's AI task force, the Super Intelligence Force (SIF), required AI developers to report security incidents immediately and remediate damage, following a security breach at Anthropic. Critics note, however, that because AI agents act without specific user instructions, it is unclear whether developers or users should be held responsible.

Provider claims

Bessent and Sacks: liability for damages under current law is more effective than new regulation (as relayed in the report).

Why it matters

Following the incident-reporting mandate covered in today's briefing, this signals that the US is leaning toward litigation and law enforcement rather than new regulation. Both companies that build agents and companies that deploy them should revisit how contracts and operating policies allocate responsibility when incidents occur.
